Jack Smith’s Strongest Witnesses Were Republicans

“I personally find it very hard to understand how our investigation can be viewed as partisan when the strongest witnesses… were Republicans.”
That was former special counsel Jack Smith — under oath, in a hearing titled like a wanted poster — answering Sen. Chris Coons. He named Rusty Bowers and Mike Pence. Not MSNBC hosts. If your strongest witnesses against a Republican president are Republicans, the partisanship problem is not where you keep pointing the finger.
The Summons
Chairman Chuck Grassley framed the day before the first question landed. Smith’s election case, he said, was about “mapping out the Republican apparatus.” Donor checks — Grassley said more than 4,700. Reams of personal data on “thousands” of Republicans. Media communications swept up. The hearing title did the rest: Oversight of Jack Smith’s Abuse of Authority and the Targeting of Republicans and Related Matters. Pre-game: Roll Call.
Ranking member Dick Durbin called the conspiracy talk baseless, noted Senate Republicans refused Smith for months while running hearings without him, and accused colleagues of contorting themselves to support Trump’s lies about 2020 and January 6.
Smith’s opening was blunt: no partisan loyalty; investigation developed proof beyond a reasonable doubt that Trump engaged in serious crimes against the nation; he would bring the same case against a Republican or a Democrat; “I will not be silenced” by threats of prosecution. That is a prosecutorial assessment, not a jury verdict. Flag it. The election case never reached a jury. Volume 1 of Smith’s report said that but for Trump’s return to the presidency, the Office assessed the admissible evidence was sufficient to obtain and sustain a conviction. SCOTUS immunity narrowed DOJ’s theory. Cases died with the return to office. None of that erases the receipts. It just means the country never got the trial the indictment was written for.
The Witness List They Pretend Not to Know
Start with the people Smith said would have carried the case — and the Republican names already in the public record.
Mike Pence refused the Eastman theory that the vice president could reject or return electoral votes. He testified to a grand jury. Rusty Bowers, Arizona House speaker, refused fake-elector pressure and told the Select Committee Rudy Giuliani’s theories arrived without evidence. Brad Raffensperger got the “find 11,780 votes” call and held the line. Bill Barr told Trump the stolen-election claims were bullshit — Barr’s word — and resigned. White House counsel Pat Cipollone, aide Cassidy Hutchinson, Acting AG Jeffrey Rosen, Deputy Richard Donoghue, Trump campaign attorney John Eastman’s own paper trail, and fake electors who later said they would not have signed if they understood the scheme. Liz Cheney and Adam Kinzinger put the Select Committee’s Republican fingerprints on the record too. The plot was not a vibe. Fake elector slates in seven states. The Raffensperger call. Barr’s internal demolition of the fraud narrative. Pressure on Pence. Trump’s December 19 “Be there, will be wild!” tweet. The 2:24 p.m. January 6 tweet attacking Pence while the Capitol was under attack. Jeffrey Clark’s draft DOJ letter — cited with the immunity caveat that official-act analysis later constrained charging theories. Giuliani pitching Bowers theories with no evidence. Smith told senators today the toll records (who called whom, how long — not content) helped prove intent to exploit January 6 violence to delay certification.
Republicans know these names. They built careers next to half of them.
Oversight as Amnesia
So what did the majority spend its oxygen on?
Donor lists. Mapping the “apparatus.” Toll records as the scandal of the century. Sen. John Kennedy asking about Smith’s wife’s politics, then announcing Smith made him want to “throw up.” Sen. Eric Schmitt waving a poster about an Atlanta Hawks game, calling Smith a “total dirtbag,” hinting at perjury — then watching the board get yanked when it turned out Smith had gone to an Iowa Hawkeyes women’s game to see Caitlin Clark in Maryland. Sen. Amy Klobuchar said a senator confusing Hawks and Hawkeyes and then calling a witness a dirtbag deserves an apology. Sen. Darlene Graham, holding her late brother Lindsey’s seat, accused Smith of bullying allies; Smith said Lindsey Graham likely would have been a witness, investigated Trump’s claims, and found them false.
That is not a search for who tried to overturn an election. That is a search for a different defendant.

What They Did Not Ask
If the point was truth about overturning elections and who carried out the plot, the empty chairs in the questioning are the story:
- Who organized fake electors in seven states, and who knew the slates were not contingency theater?
- What exactly was demanded of Mike Pence, and what did Eastman’s memos propose?
- Why press Raffensperger for 11,780 votes after state officials and Barr’s DOJ rejected the fraud case?
- What did Barr tell Trump about the evidence — and when did Trump keep saying the opposite anyway?
- What did the December 19 “will be wild” tweet and the 2:24 p.m. Pence attack tweet do in real time?
- What did Hutchinson and Cipollone describe about the president’s conduct as the Capitol was breached?
- Did Trump know the claims were false when he kept making them?
Those are not trick questions. They are the indictment. Skipping them while screaming “truth” is not oversight. It is memory hole with a gavel.
The Toll Flashpoint Is Real — And Still Not the Plot
No halo for process absolutism either way.
House Republicans released a toll-records report. Members of Congress have a legitimate institutional interest in how far prosecutors reach into legislative communications. Speech-or-debate fights are not cartoon villainy. Smith’s defense today: non-content toll data, Public Integrity consultation, needed because White House switchboard records were incomplete, aimed at proving contacts tied to delaying certification amid violence — not wiretaps, not call content. You can argue the subpoena edges were aggressive and still notice the majority never lingered on fake electors. Process fights that erase the underlying scheme are not accountability. They are substitution.
Both Parties, Same Blind Spot
Democrats do not get a halo.
The Select Committee was real evidence work wrapped in political production — prime-time packaging, narrowed Republican membership, and a referral that still never produced a jury verdict. Democrats who treated every charging document as civic communion should sit with the fact that SCOTUS immunity, delays, and the 2024 election ended the federal election case short of trial. Celebrating an indictment is not the same as proving a case to twelve citizens. And if your only theory of January 6 is “Trump alone,” you are soft-pedaling the Republican officials, lawyers, and electors who had to say no for the plot to fail.
Republicans who spent five years calling January 6 a “tourist visit” or a false-flag now summon Smith for truth while treating Pence, Barr, Bowers, and Raffensperger like unpersons. You do not get to launder a pressure campaign by prosecuting the prosecutor.
Questions for the Memory Hole
If Smith’s strongest witnesses were Republicans, why is the hearing titled like he invented a Democratic conspiracy?
If Grassley wanted the full “apparatus,” why not walk the committee through fake electors state by state?
If toll records prove “targeting,” why did Smith say they showed efforts to exploit January 6 violence to delay the count?
If Schmitt can confuse the Hawks with the Hawkeyes and still call a witness a dirtbag on national TV, what else on the poster board was theater?
If Lindsey Graham investigated Trump’s claims and found them false — Smith’s words today — why is the sister’s questioning aimed at shame instead of that finding?
If Democrats want norms, will they admit the country never got a jury verdict on the election case — and that immunity doctrine changed the charging map?
If Republicans want “truth,” can they say out loud what Barr called the fraud claims?
Closing Argument
They wrote the hearing title before they wrote the questions. They dragged Jack Smith in to answer for donor checks, toll records, and loyalty tests, then treated the Republican witnesses who stopped the overturn effort like background extras. Coons asked the only structural question that mattered, and Smith answered it: the strongest witnesses were Republicans. Schmitt gave the country a Hawks-vs-Hawkeyes flop and a dirtbag punch line. Kennedy wanted to throw up. Darlene Graham wanted shame. The fake electors, the 11,780, Pence, Barr, and the tweets sat in the indictment and the report like uncalled exhibits.
That is not oversight. That is amnesia with better lighting. The plot had names, dates, calls, and Republican refusals. Summoning Smith for “truth” while skipping the plot is the hypocrisy. The rest is stagecraft.
