SET THE PRECEDENT

2026-10-14

Quick question for you. When is a court-authorized search “accountability,” and when is it “what authoritarians do”? Depends which jersey got the knock.

The warrant, not the fan fiction

Homeland Security Investigations, ICE’s investigative arm, executed a court-authorized search warrant at Rep. Ilhan Omar‘s Washington-area home as part of an ongoing federal criminal investigation, the Justice Department confirmed, per Fox News. Two sources close to the probe told Fox the search ties to a criminal fraud investigation into immigration paperwork filled out by her late father when she was a child.

Omar has not been charged. She has repeatedly denied immigration-fraud allegations. Long-running political claims about a 2009 marriage have never produced charges, and Omar denies them. This piece invents none of the sealed affidavit.

We already covered the midterm “rallying point” both-sides frame in RALLYING POINT. Tonight’s red costume is narrower: the selective scream.

The blue eruption

House Minority Leader Hakeem Jeffries called the search “deeply disturbing” and raised “serious questions about the continued corrupt weaponization of the federal government against Donald Trump’s adversaries,” per Fox.

Rep. Pramila Jayapal: “This is what authoritarians do.” Rep. Ted Lieu called it an “outrageous abuse of power,” noting Omar’s citizenship and refugee admission. Sen. Bernie Sanders: Trump is “weaponizing the federal government to silence opposition.” Squad colleague Rashida Tlaib said Trump is “grossly abusing his power,” and Alexandria Ocasio-Cortez called it an “unprecedented abuse of power.” Sen. Tina Smith tied it to election interference with Minnesota voting already underway.

If a warrant exists and no one has seen the affidavit, volume is not evidence, and “weaponization” is not a substitute for reading the sealed pages.

The red costume: same raid energy, different year

Rep. Nancy Mace (R-S.C.) put the hypocrisy on a bumper sticker, per Fox:

“All those who celebrated the raid of Mar-a-Lago don’t get to cry over the raid at Ilhan Omar’s home. Trump’s political enemy raided his home. Democrats set the precedent.”

House Majority Whip Tom Emmer: “Nobody is above the law… ACCOUNTABILITY IS COMING!” Mace and Rep. Randy Fine pushed denaturalization and deportation if fraud is proven: conditional language that still outruns a charging document.

SET THE PRECEDENT: you cannot champagne the Mar-a-Lago boxes in 2022 and then discover due process the morning HSI hits a Squad member three weeks before Nov. 3.

“No one is above the law” was the Democratic chant when the target was Trump. It does not expire when the target is Omar. A warrant is a warrant. Celebration then and catastrophe now is costume change, not a principle.

The blue costume we already mocked (briefly)

Republicans who treated every Biden-era DOJ move as existential weaponization do not get a free pass to shrug when the calendar says midterms and the target criticizes Trump. That both-sides DOJ-norms fight is exactly what RALLYING POINT already argued. This red piece is not that redo. It’s the Mar-a-Lago-cheer-to-Omar-tears specific.

Both costumes

Here’s the adult version.

A court-authorized HSI search happened. Omar denies wrongdoing and is not charged. Democrats who treated Mar-a-Lago as justice theater now hear authoritarianism in the knock. Republicans who live on “weaponization” suddenly love warrants when the address is a critic’s.

Own the boring standard: celebrate process or condemn process, the same rule for Mar-a-Lago and for a Squad member, and wait for charging documents before deportation chants.

Ask your reps: will they apply “no one is above the law” without a jersey filter, or is the precedent only sacred when it hurts the other team?
