STILL ON YOUR DIME

2026-10-13

Quick question for you. What do you call an ad a federal judge ordered off the air? Apparently, still on.

The order that met a schedule

On Sunday evening, Oct. 11, U.S. District Judge Jennifer Rochon of the Southern District of New York granted a temporary restraining order sought by a coalition led by the watchdog Common Cause. She ordered the administration to “cancel or cause to be cancelled” the taxpayer-funded ads, including any set to air Sunday night, per NBC News. CNN reports the halt took effect at 6:45 p.m. ET.

The Justice Department had told the court the ads “will not continue past tomorrow,” so why bother? Rochon said that timing didn’t make the case moot. Cancel the rest anyway.

Then the ad trackers checked the tape. Data from AdImpact reviewed by CNN, carried by News 8000, showed two spots, “Final Battle” and “Maduro,” aired hundreds of times after the 6:45 p.m. deadline. A third, “The Country He Loves,” aired as recently as 12:17 p.m. Monday.

STILL ON YOUR DIME: a court order is not a suggestion, and airtime after the deadline is not a rounding error.

Nineteen million reasons the receipt matters

The White House budget office last month moved $20 million in Customs and Border Protection money for what it called “OBBBA commemorative events,” per CNN. Senior DHS official Holly Mehringer said in a sworn declaration that the vendor, LMD Agency, had bought airtime through Sunday “at an approximate cost of $19,000,000.”

On Oct. 5, Donald Trump posted: “I have decided to do the Patriotic Ads, among others, and pay for them myself, and with money I raised for MAGA, Inc.” A White House spokesperson later said “the president’s Truth was not referring to reimbursement,” per the New York Times via The Inquirer. On Monday, a White House spokesperson said Trump did not plan to reimburse the government for what was already spent.

On CBS’s *Face the Nation*, pressed on a refund, Homeland Security Secretary Markwayne Mullin said: “Anytime we can do a public service announcement and brag about America, I’m all about it.”

The red costume: propaganda with a border sticker

DHS described the ads to the court as showing the president’s efforts on border security. CNN notes that’s “not the exact substance of many of the ads,” and DOJ conceded they attack “a generic list of ‘villains.’” One reused footage from a 2024 Trump campaign ad, per the Times.

Even Senate Majority Leader John Thune said, per AP via PBS NewsHour, “It shouldn’t be paid for with taxpayer dollars.”

Using border money to put the president’s face on national TV weeks before Nov. 3 is not a public service announcement. It’s a campaign with a purchase order.

Trump said MAGA Inc. would pick up the tab going forward. The White House said that wasn’t a refund. Mullin said brag away. AdImpact said hundreds of airings after the deadline. You can’t call the other side lawless and then treat a court order as a scheduling note.

The blue costume: purity that discovered appropriations last week

Democrats, Common Cause and the cable panels: you’re right that taxpayer-funded hype before a midterm looks grotesque. You’re wrong if you pretend both parties haven’t spent decades turning official mail, agency roadshows and “informational” campaigns into soft campaigning.

Senate Minority Leader Chuck Schumer said “Trump must return this money to the American people and there must be a full investigation.” Fair. Also fair to notice that “publicity or propaganda” statutes get loudest when the other team’s face is on screen.

If your purity starts the day the other party’s ad hits cable, it isn’t purity. It’s a press release.

We tracked the franking version in OFFICIAL BUSINESS. Different vehicle, same instinct: official channels, political payload.

Both costumes

Here’s the adult version.

About $19 million of a $20 million border-funded buy was already spent. The spots kept airing after a judge’s deadline, and the White House says taxpayers aren’t getting it back. That’s a problem no PSA label fixes. Democrats who just rediscovered appropriations law are holding a mirror, not a halo.

Own the boring standard out loud: appropriated money is not a midterm ad account, and “PSA” is not a magic word that outranks a court order.

Ask your representatives one question this week: will they back a permanent ban on this kind of buy for every administration, or only when the face on the spot wears the other jersey?
