THE VOLUNTEER EXCEPTION

2026-10-16

Good evening. What do you call a top U.S. diplomat who negotiates Iran, Ukraine, and Gaza, runs a multi-billion-dollar fund seeded by foreign sovereign wealth, and still skips the Senate and the disclosure form? In Trump’s second term, you call him a volunteer.

On Wednesday, Citizens for Responsibility and Ethics in Washington filed suit in federal court in Washington to block Jared Kushner from acting as one of the country’s top envoys without Senate confirmation or a single financial disclosure, NBC News reported. The complaint (Case No. 26-cv-3580) says he is wielding influence “without having been confirmed by the Senate and without having filed a single financial disclosure.” That is not a slogan. That is the filing.

THE VOLUNTEER EXCEPTION is the name for the dodge. Decline the salary. Skip the title. Keep the power. Pretend the Ethics Act and the Appointments Clause are optional hobbies.

Watch: Jared Kushner and Steve Witkoff’s extended 60 Minutes interview (CBS / YouTube), where Kushner renames conflicts of interest as “experience and trusted relationships.” Then read the suit.

The suit that wants the form

CREW’s complaint, covered by Law&Crime and summarized in CREW’s own release, says Kushner represents the United States in efforts to end wars between Israel and Hamas, Ukraine and Russia, and the United States and Iran. He negotiates directly with foreign leaders. He works alongside Special Envoy Steven Witkoff. Declining a salary and formal title, the suit argues, “does not change the reality” of significant executive authority, and does not free him from the Appointments Clause or the Ethics in Government Act.

CREW President Donald K. Sherman put it in plain English: Senate confirmation and financial disclosures exist so the public can judge competence and whether America’s interests come before private ones. “Kushner is not an exception. He cannot simply opt-out and expect the public to simply take him at his word.”

The White House and Kushner’s lawyer answered with the volunteer costume. Chad Mizelle, Kushner’s attorney, told NBC the suit is “without merit,” that outside ethics counsel and government ethics attorneys reviewed the arrangement, that Kushner receives no government salary or compensation, pays his own expenses, and will keep working with counsel on compliance. White House spokeswoman Anna Kelly called CREW “unserious, Trump-deranged,” labeled Kushner a “proven dealmaker,” and insisted his personal business “has nothing to do with his diplomatic engagements,” which he does volunteer at the President’s request while paying his own expenses. A White House official added that private diplomatic envoys date to George Washington.

Fair is fair: presidents have used private envoys for delicate work for a long time. George Washington did not run a $6 billion fund with roughly 99% foreign capital while brokering the same neighborhood’s wars. The history lesson is not a disclosure form.

The firm under the table

Simultaneously, Kushner runs Affinity Partners. The suit and NBC put Affinity at more than $6 billion in assets under management, with approximately 99% owned by foreign investors, including the sovereign wealth funds of Saudi Arabia, Qatar, and the United Arab Emirates, plus significant investments abroad including in Israel. Bloomberg reported Affinity’s assets at about $6.2 billion by the end of 2025. The New York Times reporting cited in the complaint and in prior coverage: Saudi Arabia’s Public Investment Fund put in $2 billion within six months of Affinity’s founding, over staff advisor objections about inexperience, due diligence, fees, and public-relations risk.

We already walked the Phoenix Financial stake in Not Personally Profiting: Kushner at the Board of Peace inaugural in February 2026 saying “People are not personally profiting from this,” while Affinity held a 7.4% stake worth more than $1 billion in Phoenix, with a July 2026 partial cash-out of more than $340 million, and CNN mapping military-adjacent holdings under Phoenix. Watch the Davos rebuild pitch: YouTube: Davos Gaza masterplan.

This piece is the lawsuit. That piece is the stake. Same badge. Same fund. Same missing form.

The red costume: drain the swamp, then staff the family

Republicans, you sold a swamp-drain. Then you ran family diplomacy on an unpaid badge so the sunlight stays off.

First term: the Justice Department reversed decades of nepotism precedent so Kushner and Ivanka could work in the White House; Kushner got a security clearance against the reported recommendation of career specialists; disclosures still happened, and those filings showed he and Ivanka made between $172 million and $640 million in outside income while in the White House, per CREW’s release. After leaving, Kushner secured billions for Affinity from governments he had worked with. Second term: same neighborhood, bigger fund, no confirmation hearing, no disclosure, volunteer sticker on the lapel.

On 60 Minutes he called conflicts “experience.” At the Board of Peace he said people were “not personally profiting.” Anna Kelly calls the overlap a tired Democratic narrative. If the volunteer badge is humility, file the form and prove it. If the badge is the product, stop calling it public service.

Private envoys are a presidential tool. A private multi-billion-dollar fund overlapping the same maps is not a costume accessory. It is the reason the Ethics Act exists.

The blue costume: scream Kushner, explain Hunter

Democrats, before you frame the CREW complaint and hang it in the campaign office: you spent years explaining Hunter Biden’s Burisma board seat while Joe Biden was the public face of the Obama-Biden Ukraine portfolio.

That was an appearance problem. It did not require a proven bribe to be an ethics failure. Senate Republican investigators (Johnson/Grassley, Senate Finance release, full joint report PDF) documented conflict optics and official concerns raised inside the government. Fact-checkers correctly noted that leaps from board seat to bribery often outran the evidence (PolitiFact). Hold both truths. Appearance is not a partisan toy. It is the standard you waved at Kushner while you soft-sold your own family board.

Same mirror for the Clinton years: foreign speaking fees and foundation money next to a Secretary of State portfolio produced years of appearance fights Democrats treated as smear and Republicans treated as open-and-shut. The honest rule is the one neither tribe likes: if your family is monetizing the region you are negotiating, the public gets the books, or you do not get the portfolio.

Guest-list ethics is not a one-party sport either. We tracked another law-and-order costume with a donor problem in THE FUGITIVE GUEST LIST. Different party letterhead. Same allergy to sunlight.

Both costumes

Red drains the swamp, then runs unpaid family diplomacy so the form never prints. Blue screams Kushner ethics, then spends a decade explaining the Burisma board as politics. One side brands experience. The other brands purity. Both treat disclosure like a weapon you only load for the other last name.

Here is the rule to laminate. If you exercise continuing significant U.S. authority, the Senate and the Ethics Act are not optional because you declined a paycheck. If your family sits on a foreign board next to the portfolio you run, appearance is the charge even when bribery is not proven. Volunteer is not a synonym for invisible.

So ask both tribes one question this week: show me the principle that survives a change of surname. If the answer starts with “proven dealmaker” or “tired narrative” or “just a board seat,” check who skipped the form first.
